As more states seek to ban conversion therapy, questions remain in judicial opinions about whether therapeutic speech is protected by the First Amendment or is non-speech conduct that can be regulated. Specifically regarding conversion therapy, some judicial opinions question whether bans on conversion therapy also includes talk therapy based on religious principles. This article compiles some of the judicial opinions in various cases and suggests that the case Tingley v. Ferguson may come under Supreme Court review.
